What they show is an extensive history of water intrusion issues from the very beginning; ongoing action taken by the HOA to study, repair, and prevent problems; and about $1 million in expenditures from Capital Reserves that were substantially funded.

As critical problems arose in 2009, the HOA paid a third-party to examine its records at the request of City of Aspen Staff. These documents were provided to City Staff who then cherry-picked excerpts and out-of -context statements in order to paint the homeowners as negligent and irresponsible.
